Mandahl Bay has been designated by the Legislature of the Virgin Islands as an Area for Preservation and Restoration. Development of the area is deed restricted and Virgin Islands law in two sections specifically prohibits the V.I. Governor from negotiating deed restricted use rights to Mandahl. An outline for the preservation and restoration of Mandhal was also signed into law.

In 2014, in direct violation of Virgin Islands law, the V.I. governor negotiated a lease agreement with Mandahl Bay Holdings to develop a resort hotel and marina with condominium complex, sewage plant, fueling depot and space for over 80 luxury yachts. In 2015, the V.I. Legislature nixed the agreement as not being properly before the body.
Full public use of the land, deeded for educational purposes, is still being curtailed in the shadow of a previous illegally negotiated lease. [The Virgin Islands Code prohibits negotiations for Mandahl by the governor unless deed restrictions are lifted. Deed restrictions remain in place for Mandahl.]
